Privacy Statement for Smart Desktop Technology

General
The Smart Desktop division of Decho Corporation is working hard to protect your privacy, while delivering products that bring you the performance, power, and convenience that you want in your personal computing. This privacy statement explains many of the data collection and use practices of the Smart Desktop product line.
The Smart Desktop products and their underlying technology are designed to group your information logically by project based on the interactions you have with your data or computing resources. Decho Corporation is committed to helping protect the privacy of your data and helping ensure that you have full control over how your data is used and distributed.
Except as otherwise described in this statement, information that is processed by Smart Desktop and stored in the local Smart Desktop database on your computer is not sent to Decho Corporation. Any information that is sent to Decho Corporation is not shared outside of Decho Corporation and its controlled subsidiaries and affiliates without your permission.
Collection and Use of Your Personal Information
When we need information that personally identifies you or allows us to contact you, we will explicitly ask you for it. The personal information that we collect from you will be used by Decho Corporation and its controlled subsidiaries and affiliates
- to provide the service(s) or carry out the transaction(s) that you requested or authorized, and may also be used to request additional information on feedback that you provide about the product or service that you are using
- to provide critical updates and notifications regarding the software
- to improve the product or service, for example, bug and survey form inquiries, or to provide you with advance notice of events or to tell you about new product releases.
Information you enter or receive in emails, documents, and other resources may be used by Smart Desktop to automatically classify resources with your projects. Both the information used to compute the automatic classification and the associations themselves are for your own use only, are stored in the local Smart Desktop database and are not communicated to Decho Corporation or any other party.
Except as described in this statement, personal information you provide will not be transferred to third parties without your consent. We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings. We will only provide those companies with the personal information they need to deliver the service. They are required to maintain the confidentiality of that information and are prohibited from using that information for any other purpose.
Personal information that is collected by Decho Corporation as part of providing you with these features may be stored and processed in the United States or any other country/region in which Smart Desktop or its affiliates, subsidiaries, or agents maintain facilities. By using this program, you consent to any such transfer of information outside your country. Decho Corporation may access and/or disclose personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Decho Corporation or the site; (b) protect and defend the rights or property of Decho Corporation and its family of Websites; or (c) act in urgent circumstances to protect the personal safety of Decho Corporation employees, users of Decho Corporation products or services, or members of the public.
Collection and Use of Information About Your Computer
After Smart Desktop has been installed, the software may periodically upload statistics to Decho Corporation that allows us to monitor the accuracy of the Smart Desktop machine intelligence engine. This information is anonymous, statistical data and does not contain personally identifying information. This data allows us to understand when a Smart Desktop project assignment (prediction) has been corrected by the user and applies to the various applications that Smart Desktop supports.
The Smart Desktop release includes features that access the Internet to provide you web search functionality. These features are available any time you have an active connection to the Internet.
Please Note: Throughout the duration of the Smart Desktop beta Smart Desktop will be collecting the above statistics as a means to measure the accuracy and performance of the Smart Desktop product and machine intelligence engine. The official Smart Desktop release will enforce an opt-in model for users wishing to participate in the Smart Desktop Customer Experience Improvement Program.
Application Integration
Smart Desktop presents Smart Folders in the Windows Explorer toolbar. The interface for this integration is the same interface used for extending Microsoft Internet Explorer. As a result a Smart Desktop toolbar option appears in the Internet Explorer toolbar list. Smart Folders are not an applicable feature to Internet Explorer and have been disabled but could not be eliminated from the menu.
Security
Decho Corporation is committed to helping protect the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure.
Removing Smart Desktop from your system
Should you choose to remove Smart Desktop from your system, the uninstall program can be executed from the Microsoft Windows Control Panel. On Windows XP systems this can be in Add or Remove Programs and on Windows Vista can be found in Programs and Features.
Changes to the privacy statement
Decho Corporation may occasionally update this privacy statement. The "last updated" date at the top of the privacy statement will be updated with every revision. The revised privacy statement will be maintained on the www.smartdesktop.com/license_agreements page. We encourage you to periodically review this privacy statement to be informed of how Smart Desktop is protecting your information.
